Trump Administration Prohibits Visas for Men Competing in Women's Sports

USCIS Policy Updates on Gender and Sports

Recent announcements from the U.S. Citizenship and Immigration Services (USCIS) detail significant updates to their policy concerning foreign male athletes and their participation in women’s sports. This change aligns with an executive order from President Trump aimed at restricting male participation in women’s athletics.

In a statement, a USCIS spokesperson emphasized, “Men don’t belong to women’s sports.” The changes aim to close gaps that allowed biological men to enter elite women’s sports based on a claim of gender identity, which the agency argues exploited advantages inherent to biological women.

The new guidelines indicate that when assessing visa eligibility for non-citizens, USCIS will view participation by male athletes in women’s sports as a negative consideration. They will particularly impact the elite athlete visa classifications such as O-1 and E categories, aimed at individuals with extraordinary abilities.

The USCIS release also stated that male athletes transitioning to compete in women’s sports are not demonstrating a commitment to ongoing work in their extraordinary fields. This policy reflects a broader concern that allowing male athletes to compete might not align with the national interest.

These regulations are set to take immediate effect, affecting applications submitted on or after the announcement date. According to Tragesser, “Only female athletes should receive visas for participation in women’s sports,” highlighting a belief that this stance represents a larger, often unheard demographic advocating for safety and fairness in athletics.
