Sen. Eric Schmitt's latest book outlines a possible strategy for defeating Democrats in legal battles.

Conservative Strategy for Legal Challenges

First on FOX: A Senate Republican has outlined a strategy for conservatives to effectively challenge Democrats in court.

Before joining Congress, Eric Schmidt, a former Missouri Attorney General, was active in litigation during the Covid-19 pandemic. He notably filed numerous lawsuits against the Biden administration, even taking action against Dr. Anthony Fauci and China.

Through his efforts, Schmidt has highlighted inconsistencies revealed during legal proceedings, resulting in significant settlements that often targeted Democratic policies.

In an interview with Fox News Digital, Schmidt emphasized that their fight focused on restoring individual liberties against government overreach. He asserts that the left is wielding its legal framework to suppress opposition and maintain administrative power. Schmidt believes that with the right arguments, conservatives can prevail.

His latest book, *The Last Line of Defense: How To Beat the Left in Court*, serves as a guide for attorneys general nationwide. Schmidt describes it as a practical manual reflecting lessons learned from confrontations with progressive legal strategies.

He critiques the left’s approach, suggesting that they typically create crises—whether real or orchestrated—to advance their agenda against those who oppose them.

Schmidt has even taken international legal action, including suing China for its handling of the Covid-19 outbreak. He argues that the Chinese Communist Party withheld crucial information and hoarded high-quality PPE, leading to a $24 billion judgment earlier this year.

In his first year as a lawmaker, Schmidt also took aim at former President Joe Biden’s student loan debt cancellation plan, which was ultimately blocked by the Supreme Court after he focused his legal arguments on a local service provider.

He views the pandemic as a critical moment that sharpened his focus on governmental overreach.

His lawsuits against Fauci included allegations of censorship related to discussions of the virus’s origins, stating, “He wanted to shut up anyone who talked about it being a lab leak,” asserting now that the evidence points to the Wuhan Institute as the source.

Schmidt admires justices like Antonin Scalia and Clarence Thomas for their constitutional interpretations, claiming there’s been a significant shift in the judiciary’s approach. He notes the Supreme Court, currently clear in its conservative majority, has gradually filled lower courts with appointees from the Trump administration.

Pushing Back Against Partisan Politics

When questioned about the influence of partisanship on the judiciary, Schmidt responded that the system is moving away from the “progressive encroachments” that began under Woodrow Wilson. He emphasizes that the Constitution should be interpreted as it is written—nothing more, nothing less.

“I don’t need judges to share my views,” he remarked. “I just want them to uphold the Constitution.”
