California Takes Legal Action Against Plastic Bag Manufacturers
Governor Gavin Newsom has initiated a major lawsuit against plastic bag manufacturers in California, accusing them of defrauding consumers. This action comes after the state’s Attorney General, Rob Bonta, filed charges against companies like Novolex, Interplast, and Mettler for alleged false advertising and environmental claims.
Bonta’s investigation revealed that only two recycling facilities in California claim to accept plastic bags, and neither could verify that the bags were actually recycled. “Even if consumers dispose of these bags properly, they are overwhelmingly not recycled in California,” he stated. “The truth is that the producers have known, or should have known, for years.”
Before the lawsuit was initiated, four other plastic bag manufacturers, including Revolution Sustainable Solutions and Advance Polybag, settled with the state by agreeing to stop selling plastic bags and paying over $1.75 million. One company, Advance Polybag, denied the allegations but acknowledged that settling made more sense from a business perspective.
According to Bonta, these seven companies dominate the plastic bag market in California, supplying billions of bags to grocery stores under the guise that they meet recycling standards. The investigation, which began in 2022, aimed to verify the manufacturers’ claims about recyclability. Unfortunately, the outcome showed that billions of plastic bags had instead ended up in landfills, incinerators, or scattered in the environment.
“Despite manufacturer claims and widespread consumer belief, these plastic bags do not appear to be generally recyclable, much less ‘instate recyclable,'” Bonta concluded.
