Biden Administration’s FBI Allegedly Retaliated Against Whistleblower

The House Judiciary Committee has raised serious concerns regarding the Biden administration’s FBI, claiming it misused the confidential information disclosure process to retaliate against a whistleblower. Reports indicate that they even attempted to interrogate him while denying his wife’s repeated requests for legal representation.

In a letter dated Monday, Committee Chairmen Jim Jordan (R-Ohio) and Jen Quiggans (R-Va.) informed FBI Director Kash Patel that the Biden administration allegedly bypassed whistleblower protections to launch an investigation into Special Agent Valentine Fertitta in 2024.

Mr. Fertitta, who has exposed the FBI’s misuse of “law enforcement” practices, experienced an unusually lengthy evaluation for his security clearance. During this time, the FBI sought to interrogate his wife, Emily Fertitta, subjecting her to two days of interviews.

Mrs. Fertitta, understandably concerned, requested an attorney to be present. Unfortunately, the Justice Department effectively denied this request. According to documents the committee obtained, FBI investigators did not allow Mrs. Fertitta to consult with an attorney during the interview nor provided her with the chance to review the FBI’s interview guidelines beforehand.

In further detail, the committee’s letter stated that the FBI informed Mrs. Fertitta that they would not provide any policy guides, manuals, or summaries related to the interview. It was emphasized that “the lawyer may not be able to advise you, ask you questions, or prevent you from answering questions during the interview. Basically, the lawyer just sits there silently.”

This request for Mrs. Fertitta to participate in an interview contradicts the standard security clearance evaluation process. According to the agency’s SEAD 4 guidelines, denying spousal privilege—where a spouse can refuse to testify against their partner in legal matters—is not permitted. Moreover, agencies do not possess the authority to dismiss requests for legal representation.

Interestingly, the letter from the committee did not specify the exact nature of the actions Mr. Fertitta was aiming to expose in his role as a whistleblower. However, the Judiciary Committee has requested that the FBI turn over all documents related to the investigation of the Fertitta family, with a deadline set for November 10, 2025.
