The Department of Homeland Security (DHS) recently contested a report by a local NBC News affiliate concerning the arrest of an undocumented immigrant in California. The report indicated that 42-year-old Heraldo was apprehended by federal agents as he was leaving for work in San Jose.

According to NBC Bay Area, video footage from the family’s ‘Ring’ camera showed that at 7:45 a.m., Ms. Herold was driving to a construction site when several people, thought to be federal agents, approached her vehicle and instructed her to exit.

Heraldo’s wife, Idalia, claimed to be a U.S. citizen and attempted to intervene during the incident. She alleged that an agent, who was not in uniform, hit her 22-year-old daughter with a baton, though this moment wasn’t recorded on video.

DHS Assistant Secretary Tricia McLaughlin addressed the issue on X, criticizing local agencies for not sharing all relevant information regarding the arrests made.

She stated, “Of course @NBCNews refuses to tell the American people that this illegal alien from Mexico has a rap sheet that includes lewd and lascivious conduct with a child, spousal violence, domestic violence, compensation for prostitution, and felony re-entry after deportation.”

In detail, McLaughlin confirmed that ICE agents arrested Gerardo Rojas-Leyva, an undocumented individual from Mexico with a history of violent offenses. She explained that Rojas-Leyva did not produce identification, resisted arrest, prompting officers to use a Taser to subdue him.

According to McLaughlin, Rojas-Leyva’s criminal record includes serious charges such as lewd acts with minors and spousal assault. She emphasized the stance of former President Trump and Secretary Noem, stating that individuals who break the law face consequences and that criminals who are undocumented are unwelcome in the U.S.

Previously, McLaughlin criticized NBC over another report insinuating that ICE had exploited a young girl with autism to pressure her illegal immigrant father into surrendering. She deemed it a “disgusting smear” against ICE personnel.

In emphasizing the humanity of law enforcement, McLaughlin stated, “Keep in mind that the men and women of ICE are fathers and mothers, sons and daughters. They just want to go home to their families at night and serve our great country.”
