Investigation into Medicaid Spending on Undocumented Immigrants

The Trump administration has announced plans to investigate Medicaid spending related to undocumented immigrants in at least six states governed by Democrats. This investigation aims to tackle issues of waste, fraud, and abuse in the public health care landscape.

A preliminary audit by the Centers for Medicare and Medicaid Services (CMS) indicated that California, Washington, D.C., Illinois, Washington State, Colorado, and Oregon collectively spent over $1.3 billion on health care for undocumented immigrants predominantly between 2024 and 2025, with Medicaid funds being utilized.

Federal law prohibits using Medicaid funds to cover health insurance for undocumented immigrants, though it does allow for coverage of emergency medical services regardless of immigration status.

The administration has accused these Democratic-led states of misusing federal Medicaid funds to provide extensive healthcare services to undocumented individuals.

Chris Pope, a public health policy expert, commented, “Medicaid is the largest source of federal funding to states. What began as an aid system for eligible beneficiaries has led to various exploitations by states.”

Pope further remarked, “Be wary of any claims that state health care expenditure does not draw from federal funding.”

In response, leaders from the accused states maintained that their practices comply with federal law, arguing that the investigation is based on incorrect initial findings.

Mark Williams, spokesperson for Colorado’s Office of Health Care Policy and Financing, stated, “Our premium payments for undocumented individuals are lawful. The figure of $1.5 million cited is incorrect and contested by our experts.”

He added, “The mention of such inflated numbers is regrettable, especially since this discussion is still unfolding.”

According to CMS’s initial audit, California’s spending on undocumented immigrants exceeded $1 billion, Illinois accounted for nearly $30 million, while Oregon’s spending topped $5 million.

California Governor Gavin Newsom’s office has dismissed these claims as “false.”

CMS Administrator Dr. Mehmet Oz also shared insights on the issue via a lengthy post on social media.

“Our initial audits show over $1 billion of federal taxpayer money has funded Medicaid for undocumented immigrants, and we intend to reclaim those funds,” he stated. He highlighted the ongoing debate surrounding the legality of providing services through Medicaid to undocumented individuals.

“It is crucial that we eliminate fraud and misuse to protect the Medicaid program for its rightful beneficiaries,” he continued, emphasizing the administration’s focus on these matters. Dr. Oz argued that while states must provide emergency care regardless of legal status, some states are extending these funds unlawfully to undocumented immigrants.

He concluded, “Our audits revealed concerning practices, with several states improperly utilizing federal tax dollars for programs that allegedly rely on state funding, covering individuals with serious criminal convictions.”

Dr. Oz pointed out, “If we don’t question these expenditures, taxpayers will continue to pay for Medicaid for undocumented individuals, contrary to assertions from some Democrats and media.”
