Federal Judge Orders Release of Immigrants from Detention Center
A federal judge in Chicago has mandated that the Department of Homeland Security (DHS) must release over 600 undocumented immigrants currently held in a suburban detention facility. The judge has claimed the agency is guilty of “repeated and serious violations” of existing court-approved consent decrees that dictate who can be detained under U.S. immigration law.
U.S. District Judge Jeffrey Cummings stated that more than 600 detainees at the Broadview ICE Center should be “posted on bail and enrolled in ICE’s Alternative to Detention (ATD) program” by November 21. He pointed out a troubling “pattern of unlawful arrest and confinement.”
This ruling originates from the case of Margarito Castañón Nava v. DHS, a class action lawsuit that alleges federal authorities have unlawfully detained numerous immigrants who aren’t subject to mandatory detention or final removal orders. This is a clear violation of a statute established under the Biden administration and then inherited by Trump’s administration.
In his decision, Judge Cummings criticized the DHS for keeping immigrants in “unsafe and unsanitary” conditions, noting that detainees were crowded into facilities with “overflowing toilets.” He further highlighted a recent significant shift in the department’s interpretation of its detention powers as a “180-degree change” from earlier legal standards.
This ruling could lead to the most considerable single-day release of ICE detainees in Illinois in some time. Immigration activists may soon be able to free many individuals arrested during Operation Midway Blitz, a crackdown initiated by President Trump that disturbed communities in the Chicago region.
“Today was a good day because the court ordered the immediate release of 13 people who were wrongfully arrested and detained by federal immigration officials,” remarked Michelle Garcia, assistant legal director for the ACLU of Illinois. “More than 600 others may soon be set free as the courts hold the federal government accountable for its actions. This is a positive step towards addressing years of wrongful arrests.” However, DHS officials have criticized the ruling, arguing that it jeopardizes national security and law enforcement efforts.
DHS representatives have condemned the decision. Tricia McLaughlin, the Assistant Secretary for Public Affairs at DHS, stated, “Activist judges, sanctuary politicians, and violent mobs have been trying to obstruct our law enforcement officers from executing their duties to remove dangerous individuals.”
“Now, an activist judge has ordered the release of 615 undocumented immigrants into the community, endangering American citizens,” McLaughlin added.
Furthermore, Judge Cummings has instructed DHS to identify any detainees who are considered a “high public safety risk” and may remain in custody. He also required a compliance report to be submitted by November 24.
