Bondi promises to appeal after judge throws out Comey and James indictments

Judge James Comey Dismisses Justice Department Lawsuit Against Letitia James

U.S. District Judge Cameron Curry recently ruled in favor of dismissing criminal charges against former FBI Director James Comey and New York State Attorney General Letitia James. His decision came after determining that the prosecutor, Lindsay Harrigan, who filed the case, was not legally appointed.

The ruling validated Comey’s defense, which claimed that Harrigan’s interim appointment as U.S. attorney for the Eastern District of Virginia was improper, rendering the indictment invalid.

Following the judge’s decision, U.S. Attorney General Pam Bondi called for legal measures against Comey and James. She expressed her intent to hold them accountable for their actions, stating, “We will take all legal steps, including immediate appeals.” Bondi added that she wasn’t worried about individuals facing serious charges, asserting, “His actions were a betrayal of the public’s trust.”

In September 2025, Comey faced charges of lying to Congress and obstructing an investigation related to his testimonies regarding the FBI’s Crossfire Hurricane probe. He has maintained that his statements were truthful and characterized the case as a politically motivated attack.

Separately, in October 2025, Letitia James was indicted on charges of mortgage and bank fraud. Prosecutors allege she misrepresented the purchase of a Virginia home as a secondary residence, aiming for more favorable loan terms, ultimately profiting nearly $19,000 over the loan’s duration.

Bondi, while recognizing Harrigan’s appointment, defended her qualifications, asserting confidence that they would succeed in court. She emphasized that Harrigan was an excellent U.S. attorney capable of successfully pursuing the case against James and Comey.
