Judge Overturns Guilty Verdict in $7.2 Million Theft Case
A judge in Hennepin County, Minnesota, has reversed a guilty verdict related to a man accused of defrauding taxpayers of $7.2 million.
The case involves Abdifatah Yusuf, who operates a home health care business named Promise Health, from a mailbox. Yusuf and his wife, Lulu Ahmed, were charged with defrauding Medicaid in what has been described as a scam.
Despite the jury’s swift guilty verdict, Judge Sarah West determined last week that they had made a mistake, effectively acquitting Yusuf.
A defense attorney, Joe Tamburino—who is not part of the case—examined the verdict and explained that the judge found the state’s arguments to depend heavily on circumstantial evidence. He pointed out that the state hadn’t sufficiently eliminated other possible explanations.
Interestingly, even Judge West expressed concerns about the potential for ongoing fraud at Promise Health.
According to the Minnesota Attorney General’s Office, Judge West was elected in 2020, and her current term is set to expire in January 2027.
In August, the jury had found Yusuf guilty on six counts of aiding and abetting theft by deception. Reports indicate he allegedly funneled the stolen funds into luxury vehicles, designer clothing, and high-end furniture.
Minnesota Attorney General Keith Ellison weighed in, stating that exploiting medical funds meant for the underprivileged to satisfy personal desires is unacceptable. He emphasized that the people of Minnesota value helping each other and pointed out that individuals like Yusuf undermine that spirit.
One juror mentioned feeling shocked by the judge’s decision, saying that he and the other jurors firmly believed Yusuf was “unequivocally guilty” based on the evidence presented.
The attorney general’s office has since filed an appeal against the ruling, arguing that it undermines the jury’s decision, as noted by local news.
Video footage allegedly shows the mailbox associated with Yusuf’s business.
In earlier reports, a Minnesota district court judge ruled that transgender individuals on Medicaid could receive gender reassignment surgeries, which lifted a decade-long ban on such procedures statewide. Most recently, in 2024, an election judge in Minnesota faced felony charges for purportedly allowing unregistered voters to participate in that year’s election.
