Dallas County DA Will Not Pursue Death Penalty for Immigrant Charged in Beheading
The Dallas County District Attorney’s office, led by Democrat John Clouzot, has decided not to pursue the death penalty in the case of an undocumented immigrant accused of beheading a motel manager. This decision was shared by prosecutors during a court appearance in November.
Jordanas Cobos Maritones faces capital murder charges stemming from the alleged beheading of Chandra Nagamalaya on September 10. The complexities surrounding Cobos-Martinez’s immigration status have led to concerns about the prosecution, as highlighted by a report from a media outlet. A final decision regarding the case is expected to come by January 8, 2026.
“Based on our investigation and my discussions, Texas is not pursuing the death penalty,” Prosecutor Julie Johnson stated during the hearing on November 20. “However, we maintain the option to reconsider if circumstances change.”
Reports indicate that the incident began when Cobos-Martinez requested a co-worker to relay a message to Nagamalaya regarding a malfunctioning washing machine. Subsequently, surveillance footage captured him wielding a machete and attacking Nagamalaya, even kicking his head afterward and discarding him in a trash can.
Former President Donald Trump commented on the case, expressing outrage over the brutal murder, claiming that the assailant, an illegal immigrant from Cuba, should never have entered the United States. Trump pointed out that Cobos-Martinez had a violent past, including accusations of child molestation and auto theft, saying he was released back to Cuba due to the Biden administration’s policies.
Although several previous charges against Cobos-Martinez were dropped, he was convicted of a lesser offense in connection to carjacking in California. The Department of Homeland Security indicated that he had been subject to a removal order to Cuba prior to the incident and had recently been released from a detention center under supervision.
On September 14, ICE took action to detain Cobos-Martinez again. Assistant Secretary of Homeland Security Tricia McLaughlin commented that this tragic event might have been averted if Cobos-Martinez had not been released into the community.
Interestingly, Clouzot has received substantial financial backing from a political action committee associated with George Soros during his 2022 election campaign.
