House Republicans issue subpoena to former special counsel Jack Smith for testimony

Jim Jordan Summons Jack Smith for Deposition

House Judiciary Committee Chairman Jim Jordan (R-Ohio) has summoned former special counsel Jack Smith to provide a deposition, intensifying the scrutiny surrounding one of President Donald Trump’s key political adversaries. According to a subpoena obtained by Fox News Digital, Smith is expected to appear before the committee on December 17.

In a letter accompanying the subpoena, Jordan stated, “Due to your service as special counsel, the committee believes that you possess information essential to its oversight of this matter.”

This upcoming deposition, conducted in private, comes amidst heightened focus from House and Senate Republicans on Smith’s investigation into issues related to Trump’s election, which has seen involvement from numerous Republicans, associated organizations, allies of Trump, and the media.

Smith has stood firm in support of his work as special counsel, which culminated in two criminal cases against Trump concerning the 2020 election and alleged mishandling of classified documents. Smith ultimately dropped those cases after Trump secured the 2024 election, citing a Justice Department policy that discourages prosecuting sitting presidents.

Although Smith has expressed willingness to testify publicly before both the House and Senate Judiciary Committees, a source close to Jordan mentioned that a deposition format is preferred. This setup permits each committee member to question Smith for one hour each, creating a more comprehensive record, as opposed to the typical five-minute intervals in public hearings.

Jordan’s subpoena further includes extensive requests for documents and communications relating to Smith’s tenure as special counsel. This follows a letter from the Justice Department, dated November 12, which indicated that unique accommodations would be made for Congress, allowing Smith to provide unrestricted testimony without concern for potential privilege.

Attempts to reach out to Rep. Smith and the Democratic Committee for comments have been made.

This situation is still unfolding, so stay tuned for updates.
