Judge claims California employed racial gerrymandering to benefit Democrats

California’s Redistricting Controversy

A federal judge has openly criticized the method used to redraw California’s congressional map, which was approved by voters. In a dissenting opinion, he referred to the state’s actions as “racial gerrymandering,” suggesting that the process favored Democratic candidates.

Justice Kenneth Lee highlighted that racial considerations played a role in the justices’ decision as they voted 2-1 to maintain the newly drawn maps. “California got its hands dirty in this sordid business when it engaged in racial gerrymandering as part of its mid-decade congressional redistricting plan to add five more Democratic House seats,” he stated.

Lee also pointed out that Paul Mitchell, the mapmaker behind the congressional redistricting, likely factored race into the creation of at least one district. This, he argued, raises concerns about the process’s integrity.

The court dismissed arguments from Republicans who claimed that the maps, part of Proposition 50, violated the Voting Rights Act by unduly favoring Hispanic and Latino voters.

This decision permits California to use the new map, which could increase Democratic representation in the House. California Republicans have announced their intention to appeal to the U.S. Supreme Court for an emergency injunction regarding the matter.

Colin Rankin, chair of the California Republican Party, expressed that the dissenting opinion aligns more closely with their interpretation of the law. He emphasized that expert testimony supported their claims of racial gerrymandering in the Prop. 50 maps, which warrant a halt to their implementation.

Lee criticized the map’s creator, who chose not to testify but reportedly boasted to associates about designing the map “to ensure Latino neighborhoods.” Lee noted that this redistricting effort was timed after Texas initiated its own, which aimed to bolster Republican representation.

Proposition 50 was conceived after California Governor Gavin Newsom and other Democratic leaders proposed redrawing congressional boundaries to challenge five Republican strongholds, responding to Texas’s efforts to gain political ground.

Governor Newsom commented, asserting that voters in California decisively supported Proposition 50, which he argues stands against attempts to manipulate the electoral process, particularly as seen in Texas.

Generally, redistricting occurs once every decade following the census, making mid-decade changes quite unusual.
