Families Suffering Due to Big Pharma's Legal Tactics

Health Care Challenges for Families

For many mothers, family health is the top priority. Yet, countless families struggle to maintain their well-being. Health insurance costs are on the rise and medications are becoming pricier. It’s concerning that about 1 in 5 Americans are cutting back on their dosages or rationing their prescriptions to save money.

President Trump has taken steps to lower drug prices. A new initiative, TrumpRX, allows families to buy medications directly from manufacturers. He’s also urging large pharmaceutical companies to reduce the prices they charge in the U.S. compared to Europe. There’s potential for more progress here, but Congress needs to back his efforts.

Generic drugs represent a significant opportunity to lower health care costs for everyone. Typically, generics are priced about 80-85 percent lower than their brand-name counterparts, yet they can be just as effective. Since drug prices are a major factor in rising health expenses, increasing the availability of generics could ease financial burdens for many families. Unfortunately, the current system for generics, which was last updated in 1984, is now ineffective. Years of pharmaceutical company regulations have kept affordable generics off the shelves, driving prices higher.

The Hatch-Waxman Act, established three decades ago, initially created a balanced framework. It allowed branded drug companies to secure patent protection in exchange for enabling generics to enter the market after patents expired. However, branded companies have exploited this system, often initiating multiple lawsuits that delay the launch of generics. This rampant over-patenting has forced many affordable drugs out of the market for longer than Congress intended, resulting in billions spent on medication or people unable to access treatment.

Some argue that high drug prices don’t matter because insurance companies, Medicare, and Medicaid cover them. However, these growing costs lead to higher premiums, misuse of tax funds, and stresses on small businesses providing employee healthcare, which can even result in job cuts. Ultimately, these costs trickle down to workers, taxpayers, and families. That’s why numerous groups from across the political spectrum are advocating for changes to harmful patent laws, and we’re aligning with them to push for action that can lessen health care costs.

This issue boils down to choice and independence. While innovation warrants exclusivity, even icons like Mickey Mouse can’t enjoy eternal rights to their intellectual property. Families should be able to access healthcare options without being locked into high prices or limited choices.

When families can afford their medications, they tend to be healthier, more autonomous, and better positioned to thrive. On the flip side, restricting access to affordable generics creates agonizing choices and undue financial strain. By uniting to enhance access to reasonably priced generic medications, we can safeguard the health of our families and pave the way for a stronger future for ourselves and the next generation.
