The individual accused of spraying Rep. Ilhan Omar (D-Minn.) with a liquid later found to be apple cider vinegar will remain in custody as his trial approaches. A judge has classified him as a potential threat to the community.
During a court appearance, 56-year-old Anthony James Kazmiachuk was depicted by his public defender, John Fossum, as wearing a yellow jumpsuit indicative of solitary confinement. Fossum raised concerns regarding Kazmiachuk’s mental health.
While Kazmiachuk is not viewed as a flight risk, U.S. Magistrate Judge David Schultz decided it was necessary for him to stay in custody due to the nature of the charges in Hennepin County. These charges comprise a felony count of terroristic threats and a fifth-degree assault charge.
Mary Moriarty, the Hennepin County Attorney, referred to the incident as a troubling assault on Omar, who frequently faces derogatory remarks from both politicians and the public. She expressed that such actions undermine public trust in the federal government, which is supposed to ensure safety without political bias. Notably, she emphasized that state-level convictions are not eligible for presidential pardons.
Fossum argued that Kazmiachuk’s current health issues, including Parkinson’s disease and sleep apnea, need consideration and that the “risk of harm” to Omar was quite low, downplaying the liquid’s potential danger.
However, Assistant U.S. Attorney Benjamin Bejar countered that the act could have indeed resulted in personal injury, especially considering it had come into contact with Omar’s eyes. He stressed that society cannot accept individuals encroaching on the safety of those fulfilling their duties, irrespective of political affiliations.
Reports indicate that Kazmiachuk confessed to pouring vinegar on Omar during his arrest.
At the time of the incident, Omar was discussing immigration policies, advocating for a thorough investigation and legal measures against U.S. Immigration and Customs Enforcement, along with calling for the agency’s disbandment. Additionally, she mentioned that Homeland Security Secretary Kristi Noem should resign or risk impeachment.
Initially taken aback after Kazmiachuk allegedly sprayed her, Omar collected herself and proceeded to address the crowd for approximately ten more minutes.
Kazmiachuk has a prior criminal record, having been convicted of driving under the influence in both 2009 and 2010, serving one day in jail for the latter incident, followed by probation and home detention related to the earlier conviction.
