AI Regulation: A Strategic Approach

Addressing the regulation of advanced AI isn’t as simple as a game of checkers. It resembles a complex game of chess where every move carries significant weight. You have to plan several steps ahead. If you focus solely on immediate reactions, there’s a real danger of losing sight of the broader picture.

The United States stands at a pivotal moment concerning AI, with impactful policy decisions unfolding both at the state and federal levels. Recently, California and New York enacted significant AI safety laws. California’s SB 53 took effect on January 1, while New York’s RAISE Act, signed by Governor Kathy Hochul in December, is set to commence in 2027.

Both states are aware that a disjointed state-by-state framework is not feasible. They are striving for a more coordinated strategy that aligns state regulations with federal guidelines. Given their notable size and economic influence, these actions could create a pathway for federal measures, positioning New York and California as front-runners in the AI landscape.

This alignment, often referred to as “harmonization,” signifies a clear shift towards establishing a unified national standard for advanced AI systems, which is critical for national security. States can focus on local concerns like consumer protection, civil rights, and the use of AI in everyday life, thus leveraging their unique strengths.

Essentially, we need one cohesive rulebook with distinct roles yet a shared mission. It’s about maintaining America’s competitive edge in vital technologies that influence national security and global markets. As Russian President Vladimir Putin has said, the leading power in AI will be the leading power in the world. The U.S. cannot afford to lag or become fragmented during such a crucial time.

This AI leadership ties directly into national security, where proactive measures are vital, rather than reactive responses after issues arise. When states operate independently, they often find themselves in a position where they can only address liability after problems have occurred. To prevent serious risks, technical expertise and access to sensitive systems, often unique to the federal level, are necessary.

Therefore, our guide must be straightforward: it’s about implementing the frontier model safely, ensuring that America retains its lead in innovation.

This preventative strategy has already been put into action. The AI Standards and Innovation Center, initiated by the Biden administration and continued under Trump, will enable the federal government to assess advanced AI systems before they are deployed. Such centralized testing is crucial for managing risks that no single state or company can address alone.

Without this harmonization, AI firms may face a chaotic array of conflicting state regulations, stalling innovation without enhancing public safety. A consistent approach provides clarity for businesses, offers better protection for citizens, and allows states to operate effectively in their areas of strength.

Both New York and California exemplify what this balance can look like in practice as they work away from fragmented strategies towards more collaboration. This partnership aids in establishing effective national standards, complementing rather than superseding federal initiatives.

Think about how we ensure car safety. We don’t simply wait for accidents to happen and rely on lawsuits for improvement. The federal government establishes clear national safety standards, requiring rigorous testing before vehicles hit the road. Prevention is prioritized because the stakes are simply too high.

This partnership approach is not a novel idea. The U.S. has effectively managed areas such as aviation, food safety, and telecommunications in a similar manner. The federal government sets critical standards, while the states handle localized oversight. This model has spurred innovation and growth without compromising effectiveness.

In 1996, while I was working in the White House as the Internet was starting to change the economy, policymakers faced a similar choice: stick to old regulations or create a new framework tailored for emerging technologies. Choosing the latter led to the Telecommunications Act of 1996. It wasn’t perfect, but it established essential national standards and encouraged innovation, positioning the U.S. for leadership in the Internet age.

The lessons here are clear. When the U.S. establishes comprehensive standards for new technologies, we maintain our position as leaders rather than falling behind.

The chessboard is set. If the United States emphasizes prevention, synchronizes state and federal actions, and keeps the long-term vision in focus, we can guide ourselves into a new technological epoch. Winning the long game is all about playing chess, not just checkers.
