Student Could Face Jail Time for Transphobic Post

Legal Troubles for Brazilian Student Over Social Media Comments

In November 2020, Isadora Borges posted on Twitter, expressing her belief that men who identify as women were “obviously born male.” While many might see this as a personal opinion, in Brazil, such statements could lead to serious repercussions, including a potential prison sentence of up to 10 years for “transphobia” under current laws.

Although it’s been established that Borges’ comments weren’t meant to be discriminatory and simply reflect her views, her case is still in the hands of the court. In an interesting twist, legal advocacy group ADF International pushed to allow Borges to submit a written explanation about her intentions regarding her comments, which the court has permitted prior to making a final ruling.

Borges elaborated in her tweets that individuals identifying as transgender still possess the DNA they were born with, suggesting that nothing—surgery, hormones, or clothing—could alter this biological fact. Her statements drew attention, particularly after a complaint was filed by Erika Hilton, a transgender politician.

At 34, Borges is a veterinary student from Paraiba and learned about these charges only in September 2025, nearly five years post her initial tweet. This legal scrutiny stems from a framework established in 2019, where Brazil’s Supreme Federal Court classified homophobic and transphobic acts as akin to racial discrimination, intending to curb societal harm. This aligns with existing anti-discrimination laws targeting sexual orientation and gender identity.

Borges isn’t alone in facing such allegations; others, including influencers and religious leaders, have similarly faced lawsuits over their public comments. The outcome of her case remains uncertain. One can only hope for a fair resolution, standing with her in the pursuit of justice.
