Georgia Judge Grants $1 Bail to Woman Charged with Murder Following Abortion-Inducing Drug Use

A judge in Georgia has set bail at just $1 for a woman accused of murder after allegedly taking medication to induce an abortion while about five months pregnant, which violates state abortion laws.

31-year-old Alexia Moore has been in custody at the Camden County jail for nearly three weeks since her arrest on March 4. The arrest warrant utilized language reflecting the state’s restriction on abortions after six weeks of pregnancy.

During a bail hearing on Monday, Superior Court Judge Stephen Blackerby expressed concerns about the murder charge. “I think that charge is very problematic,” he remarked, further noting that it would be challenging to secure a conviction.

Blackerby set Moore’s overall bail at $2,001, requiring her to post $1,000 for each of the two drug charges in addition to the murder charge.

Moore’s case marks one of the first instances in Georgia where a woman has faced charges related to abortion since the state imposed its ban in 2019, which restricts abortions after fetal heart activity is detected, typically around six weeks into pregnancy.

Brunswick Judicial Circuit District Attorney Keith Higgins did not contest the $1 bail during the proceedings, informing the judge that the police charged Moore without first consulting his office. Before proceeding with a trial, Higgins’ office will need to secure a grand jury indictment.

Moore was released on bail on Monday, according to jail records. Her attorneys from the Georgia Public Defenders Council commented, stating, “Today’s decision is a reminder that accusations alone do not serve justice.” They emphasized the importance of courts carefully weighing evidence to ensure that everyone’s rights are respected.

Court documents reveal that Moore reported to the hospital on December 30, mentioning abdominal pain. A police warrant cited that she informed hospital staff of taking misoprostol—an abortion-inducing drug—and oxycodone, a pain medication.

According to the warrant, the baby lived for about an hour after birth in the hospital. Medical records indicated that Moore was between 22 and 24 weeks pregnant, with the medical staff aware of the baby’s heartbeat and signs of respiratory distress.
