California Judge Dismisses Charges Against Pro-Life Activist

A California judge has removed the last legal obstacle for a pro-life activist who, through undercover footage, alleged that abortion providers were profiting unlawfully from fetal tissue. This decision was made on Wednesday.

David Daleiden, the founder of the Center for Medical Progress, expressed satisfaction with the ruling, stating, “After months of delays and a rather peculiar last-minute attempt by Planned Parenthood, the charges were dismissed and the case has been fully expunged.” He referred to the ruling as a significant change to the national agreement surrounding these issues.

Alongside journalist Sandra Merritt, Daleiden had faced fifteen charges from California’s Attorney General Xavier Becerra in 2017. These charges originated from an investigation initiated by former Attorney General Kamala Harris’s office after her election to the U.S. Senate in January 2017.

Court Proceedings and Settlements

In January 2025, Daleiden and Merritt each entered pleas of no contest in relation to a settlement that dismissed the majority of the charges. According to this agreement, they avoided jail time, fines, or any admissions of guilt.

San Francisco County Judge Brian Ferrer officially dropped the remaining charges against Daleiden, effectively closing the case. In a statement, Daleiden remarked that this decision marked the conclusion of a legal journey initiated by Kamala Harris. He referred to it as a major triumph for investigative journalism, emphasizing the public’s right to uncover the truth about Planned Parenthood’s practices.

California Attorney General Rob Bonta framed the plea deal as a victory for preserving access to reproductive health care, stating that the felony conviction was now secured. The agreement required Daleiden and Merritt to adhere to all laws, including no contact with the recording victims and avoiding any illegal recordings.

Bonta added that while the Trump Administration was granting clemency to those harming reproductive health providers, his office was focused on securing convictions to safeguard Californians’ rights to reproductive health services.

The Underlying Investigations

The legal troubles for Daleiden began in 2015 when he released a video in which Merritt conversed with leaders of family planning organizations, detailing how to maintain fetal organs intact for harvesting. Following the release of this video, Harris’s office began its investigation for potential violations of California’s recording laws. An April 2016 search warrant resulted in a search of Daleiden’s apartment.

Throughout this ordeal, Daleiden alleged that the investigations were politically motivated. Although the Senate Judiciary Committee called for a federal probe into Planned Parenthood, no charges have ever been leveled against the organization.

Later, Daleiden faced legal repercussions from Planned Parenthood itself, being ordered to pay $2.4 million in damages and over $13 million in attorney fees in 2019.

As the situation evolves, thoughts linger about the broader implications and ongoing debates surrounding reproductive rights and ethical practices in health care.
