Court Directs Pentagon to Provide Greater Access to Media

Pentagon Must Restore Access for Journalists, Judge Rules

A federal judge in Washington ruled on Thursday that the Pentagon must allow qualified journalists full reporting access, stating that the Department did not comply with a previous court order. U.S. District Judge Paul Friedman expressed that the Pentagon had failed to fully implement his ruling from March 20, which found their 2025 media policy unconstitutional under the First Amendment.

The judge highlighted that the Pentagon couldn’t just issue a revised policy that kept the same core restrictions and expect to avoid consequences. “The Department simply cannot reinstate illegal policies under the guise of enacting ‘new’ measures,” Friedman remarked, emphasizing the need for compliance.

In response to the ruling, the Pentagon announced it plans to appeal. Chief spokesperson Sean Parnell indicated that the Department disagrees with the decision, claiming they have always adhered to the court’s directives and reinstated access for journalists named in the original order. Parnell asserted that a revised policy was introduced to address concerns raised by the court.

The ongoing conflict revolves around a press access framework implemented last year that requires journalists to sign strict agreements on how they gather and use information, which includes even unclassified data. This controversial requirement led to over 50 reporters losing their Pentagon credentials after refusing to sign the agreements.

The aim, according to the Pentagon, is to prevent leaks that could compromise operations and affect leadership, particularly Defense Secretary Pete Hegseth. Notably, the New York Times additionally filed a lawsuit in December, contesting the new policy and arguing that it significantly hampers reporters’ ability to interview officials and access critical information.

The Pentagon has yet to respond to additional inquiries regarding the latest decision.
