WASHINGTON — A custody dispute involving Ohio Representative Max Miller and his ex-wife has taken a troubling turn, with court documents revealing a police investigation related to their 2-year-old daughter’s broken collarbone.

Miller, who previously worked for Trump, filed for divorce from Emily Moreno in 2024, just after their child was born. They initially agreed that he would pay $2,500 a month in child support.

However, last month, Emily, daughter of Senator Bernie Moreno (R-Ohio), sought to revisit their co-parenting arrangement, expressing worries about Miller’s behavior. She stated in the court filings that he often communicates with her in a manner that is “inappropriate, aggressive, and demeaning,” which, she believes, is not beneficial for their child.

Emily highlighted that Miller has engaged in “dangerous physical acts in front of children,” adding, “I don’t think that’s in the child’s best interests.” She expressed concerns about their ability to make joint decisions regarding their daughter due to what she perceives as Miller’s non-cooperation.

In response, Miller criticized Emily’s demeanor, describing it as “increasingly confrontational, irrational, and somewhat bizarre,” suggesting that she has made numerous unverified abuse allegations to law enforcement and social services.

The police looked into the circumstances surrounding the child’s injuries, including the broken collarbone and bruised shoulder. An Ohio representative mentioned that while local authorities have investigated and seemingly cleared Miller of any wrongdoing, the inquiry into potential child abuse remains ongoing, and details have not been fully disclosed.

Miller has requested that both he and his ex-wife undergo psychiatric evaluations to guide custody decisions. Emily’s attorney responded, stating that if one is looking for abusive behavior, it’s essential to “look in the mirror” rather than at her client.

Recently, Miller also sought to subpoena his former father-in-law, Bernie Moreno, a well-known figure in the luxury auto industry and an ally of Vice President J.D. Vance. His attorney remarked that Miller’s allegations have been deemed baseless by the court, asserting that these claims are merely a strategy to manipulate the legal system against Emily, whom they describe as a loving mother unwilling to yield.

Since his election to the House in 2022, Miller has held various significant roles during the Trump administration, including positions at the Treasury Department. He has also previously been involved in a defamation suit with his ex-girlfriend, former White House press secretary Stephanie Grisham, over her account of their tumultuous relationship.

In a statement, Miller’s team noted that he has been granted a restraining order by the court, pointing out that the evidence presented against Emily was convincing enough for a judge to believe she posed a threat to Miller and others.

Restraining orders are common in divorce or custody conflicts, often requiring that ex-spouses maintain distance pending further proceedings.
