A Wisconsin family is grappling with a recent court decision to vacate the conviction of Miguel Cruz, who had been sentenced to life in prison in 2021 for the murder of his mother, Juanita Zdrojk. This case, which dates back to 2000, involved a tragic execution-style shooting that left Juanita, a 39-year-old mother of three, dead after she had witnessed a double murder in Milwaukee.

The investigation into her murder hit a dead end until Cruz was arrested in 2017. Meanwhile, Zach Zdrojk, her son, expressed his initial relief upon learning of Cruz’s arrest, feeling that justice had finally been served. “It was a very fulfilling time for us,” he mentioned, reflecting on the long wait for answers after his mother’s death.

However, after Cruz filed an appeal questioning the reliability of the DNA evidence and highlighted concerns about the sheriff’s office, the court granted him a new trial earlier this week. This was a tough blow for the Zdrojk family. “We have been very understanding of this whole process over the years,” Zach said, “but seeing the system fail us again was very discouraging.”

While the charges against Cruz remain, he is now looking at the possibility of a plea deal that could potentially lead to a significantly reduced sentence. This situation leaves the family feeling frustrated. Zach expressed his doubts about the fairness of the legal proceedings, questioning how someone with clear witness testimonies could find himself in this position. “What are we doing here?” he asked, pointing out a perceived inconsistency in how the case is being handled.

He also noted that there was informal talk about a deal that could allow Cruz to spend only a brief time in prison before being released. “It’s hard not to feel a sense of injustice in all of this,” Zach remarked, adding that the ordeal has taken a severe emotional toll on him and his siblings.

The Racine County authorities have not yet commented on the situation as the family continues to navigate the complexities of their grief intertwined with the legal system.
