Bride takes legal action following Phoenix DUI arrest, alleges officers overlooked unfavorable results

A bride’s ideal wedding quickly shifted into a troubling legal issue when she was accused of drunk driving, despite having a perfect breath test result.

Brianna Longoria, hailing from Fresno, was married just a day before Phoenix police took her into custody for DUI. Interestingly, her breathalyzer reading was a clear 0.00.

According to a federal lawsuit, she also tested negative for both drugs and alcohol.

The incident unfolded on December 29, 2024, when Longoria was stopped while driving a rental car at night, her new husband riding beside her.

Initially, police alleged she ran a red light and had issues with her car’s rear lights, but the situation escalated into a DUI investigation.

Footage shared by FOX26 revealed an officer admitting on body camera that he wasn’t expecting to administer a breathalyzer before conducting an alcohol test.

After getting a triple zero reading, Longoria was still handcuffed and arrested for suspected DUI.

One officer remarked, “I believe you have a disability,” raising eyebrows.

Police cited signs such as “red eyes” and large pupils as reasons for her arrest.

After her arrest, an officer allegedly remarked, “If you don’t drink and drive, you’ll be kicked off the team,” which Longoria’s lawyers argue suggests a troubling pressure for DUI arrests.

The lawsuit contends that the Phoenix Police Department officers violated established constitutional rules regarding DUI stops and arrests, acting to further their careers and align with what they viewed as the city’s improper practices.

The DUI case eventually unraveled, with prosecutors dismissing the charges in April 2025, though a judge later overturned her license suspension due to insufficient evidence.

Reflecting on the ordeal, Longoria stated, “My life was forever changed by the defendants’ wrongful actions.” She later filed a lawsuit in December 2025 against the city and officials, claiming that the experience delayed her cancer treatment, affected her nursing studies, and interrupted her honeymoon.

As her attorney noted, the situation involved fabricated traffic violations and evidence. Longoria is now seeking damages, changes to police practices, and the removal of her arrest from her record.
