Virginia Supreme Court rejects request to pause lower court ruling against certifying redistricting vote

The Virginia Supreme Court has turned down Democratic Attorney General Jay Jones’ request for an emergency stay concerning a lower court’s order that blocked the certification of the state’s recent redistricting results.

On April 21, Virginia voters passed a constitutional amendment by a tight margin of 51% to 49%, which would enable Democrats to redraw congressional district maps ahead of the midterm elections.

This newly proposed map seeks to eliminate four out of five Republican-held districts, giving Democrats control over ten of Virginia’s eleven congressional districts.

On April 22, Circuit Court Judge Jack Hurley issued an injunction that prevented any certification or changes to the election results, declaring the amendment process unconstitutional, according to court documents.

The same day, Jones shared his thoughts on the court’s ruling on X, stating, “My office will immediately appeal to the Court of Appeals. As I said last night, Virginia voters have spoken and activist judges should not have the power to veto the people’s vote. I look forward to defending last night’s election results in court.”

By Tuesday, the Virginia Supreme Court had officially denied the stay motion, maintaining the current block on redistricting.

This decision comes as part of a complicated legal landscape, with the court also hearing arguments regarding a separate special election challenge on Monday. Reports indicate that a final determination on that case is still forthcoming, leaving the legality of the special election and amendment process in doubt.

These legal contests in Virginia are occurring within a larger national framework of redistricting efforts. For instance, in Florida, Republicans are aiming to secure four additional seats. The outcomes of these state-level actions will significantly influence the struggle for control of the House in the coming midterm elections, as both parties strategize to maximize their advantages.
