Department of Education Investigates Smith College Admissions Policy
The Department of Education initiated an investigation on Wednesday into Smith College, a historic women’s institution, for admitting biological men who identify as women.
Reports indicate that the Office for Civil Rights (OCR) has taken action against Smith College in Massachusetts, alleging violations of Title IX. A statement from the Department of Education noted that the investigation centers around the college’s policies concerning gender identity and admission.
Concerns have arisen regarding the college’s inclusion of men in female-exclusive spaces, such as dormitories, restrooms, locker rooms, and sports teams, as highlighted in the statement.
OCR will assess whether Smith’s practices contravene Title IX of the Education Act of 1972, specifically addressing women’s safety and sex discrimination issues.
Even with existing exceptions for single-sex educational institutions, the law is focused on biological aspects and does not exempt considerations of gender identity. The statement emphasized that admitting men may disqualify the college from being labeled as a single-sex institution.
Kimberly Ritchie, assistant secretary for civil rights, expressed in a statement, “Women’s colleges lose all meaning if they admit biological males.” She further stated that allowing biological males in women’s spaces poses significant privacy and equality challenges under federal law, asserting that the Trump Administration will continue to reinforce compliance with legal standards.
Smith College commenced its efforts to accept transgender applicants in 2013 after instances where applicants were denied admission due to mismatches between their gender identity and financial aid documents, as reported by the Associated Press.
In 2015, the university announced it would admit “self-identified transgender women,” aiming to reflect a wide range of experiences among women and improve their role in promoting women’s status globally.
On its official website, Smith College states it’s committed to respecting diverse gender identities and acknowledges having transgender, nonbinary, and gender nonconforming individuals within its community. However, the college also maintains that its mission and legal status align with being an all-girls institution.
As of now, Smith College has not provided any comments regarding the investigation.
