The Department of Homeland Security has urged Wisconsin officials to keep a Nicaraguan man in custody following his arrest on charges of sexually assaulting an elderly person. This request was made public in a statement released on Wednesday.

Julio Cesar Morales Jarcan, 31, faces two counts of second-degree sexual assault and is currently being held by local police. His arrest occurred last month when authorities were contacted by a residential care facility in Fitchburg, Wisconsin, which reported that a staff member may have assaulted a vulnerable resident.

On April 27, Immigration and Customs Enforcement (ICE) took action by issuing a request for Morales-Jarcan’s continued detention.

DHS officials criticized Dane County for its previous practices, alleging that it operates as a “sanctuary jurisdiction.” They claim the county has, in the past, only given ICE a mere 30 minutes to detain individuals prior to their release.

Morales-Jarcan entered the U.S. in 2023 under a humanitarian parole program aimed at Nicaraguans but was later deemed to be in the country illegally after the program ended. “This individual is charged with two counts of sexual assault against an elderly victim,” said Lauren Biss, Acting Assistant Secretary of DHS. She criticized the Biden administration for allowing Morales-Jarcan into the country and urged local officials not to release him, emphasizing the risk of reoffending.

“It’s crucial for Wisconsin’s officials to work together and ensure that criminals are kept off our streets,” Biss emphasized.
