Postal Service Set to Permit Mailing of Handguns Following DOJ Memo

USPS Weighs New Rules on Mailing Firearms

The United States Postal Service (USPS) wrapped up public comments on proposed regulations that could permit the mailing of firearms to law-abiding citizens, potentially overturning a ban that’s been in place for about 99 years.

According to a memo from the Department of Justice’s Office of Legal Counsel, the USPS began looking into new rules following a Supreme Court ruling in 2022, specifically regarding the case of New York State Rifle and Pistol Association v. Bruen. This decision called into question the long-standing ban, which was enacted by Congress in 1927 targeting “concealable” firearms.

The memo suggests that the current restrictions under Section 1715 violate the Second Amendment, noting that they hinder lawful travel with firearms for activities like self-defense, hunting, and shooting. It argues that this regulation imposes undue challenges on transporting firearms, which are constitutionally protected as merchandise, inhibiting citizens’ rights to acquire and keep arms.

The USPS is currently deliberating on finalizing these new rules amidst opposition from certain Democratic officials and Second Amendment advocacy groups. The Department of Justice pointed to the memo when approached for comments.
