ABC challenges FCC in court, claiming the agency breached its First Amendment rights.

ABC News Accuses FCC of First Amendment Violations

ABC News has officially accused the Federal Communications Commission (FCC) of infringing on First Amendment rights through a legal filing. The network contends that recent federal regulatory actions are fostering a “chilling effect” on free speech.

This legal action comes in response to the FCC’s February announcement about investigating the daytime talk show, The View, which is owned by Disney. The FCC aims to determine whether the show breached “equal time” rules following an appearance by Texas Democratic Senate candidate James Talarico.

The network argues that The View has been regarded as a “bona fide news interview” since 2002, and therefore, the investigation is seen as a significant shift from established norms.

ABC claims the FCC is using technical regulations as a pretext to exert control over editorial content and penalize networks for engaging in political discourse. The network further maintains that applying such scrutiny to news programming undermines the constitutional protections available to broadcasters, effectively discouraging other news outlets from hosting controversial political figures.

“The FCC is pursuing enforcement action in this regard,” stated FCC Chairman Brendan Carr.

ABC pointed out that The View falls under an exemption to the equal time rule that was granted over 20 years ago. However, in late March, the FCC directed the Houston station KTRK-TV to submit a new request regarding the show’s classification as a “bona fide news interview program.”

In addition, the FCC highlighted a conflict with Disney concerning the company’s policies on diversity, equity, and inclusion.
