Oversight Committee Hearing on ATF and Industry Influence
During a recent House Oversight Committee hearing focused on “Privacy Protection and the Second Amendment,” Representative Summer Lee (D) expressed concerns that the ATF may be unduly influenced by the firearms industry.
Lee questioned ATF Director Robert Secada regarding the 34 rule proposals he introduced after his confirmation. She inquired if the ATF engaged with gun violence victims or gun control advocates, to which Secada responded, “No, we didn’t consult.”
Continuing her questioning, she asked if the ATF had consulted with firearm industry groups such as the NRA, American Gun Owners Association, or NSSF during the drafting of the rules. Secada again stated, “No, I did not.”
Despite his assertions that the ATF does not collaborate with the firearms industry, Lee pressed further on whether the agency might be perceived as being “captured” by that very industry.
She remarked, “You know the concept of industry capture? What would you say to those who look at this announcement and the process of making these rules and think that the ATF is influenced or perceives itself to be influenced by the firearms industry that is meant to support law enforcement?”
Secada responded, saying, “ATF cannot be captured by anyone. We are focused on doing our job and complying with the law. I intentionally didn’t meet anyone. We have collected information that we have noticed over the years. I’ve been doing this for 34 years, working in some of the most violent cities in America, risking my life and the lives of all my partners across the country to improve America’s communities. However, there are ambiguities in the law, and it’s important for people to understand it. When federal employees don’t grasp the law itself, we’re all at risk.”
He noted that there is frustration on both sides because “no one is participating” in the ATF’s framework of proposals, revisions, and amendments.
