Governor Spanberger Faces Criticism from Left-Wing Activists
Governor Abigail Spanberger of Virginia is encountering backlash from some progressive activists for not fully implementing the anti-deportation measures that Democrats hoped for.
On Wednesday, she chose not to veto important state bills that would have mandated Immigration and Customs Enforcement (ICE) to obtain a court warrant before entering specific public areas. The American Civil Liberties Union (ACLU) commented that this decision compromises the safety of Virginians. Interestingly, on the same day, Spanberger also approved legislation restricting immigration officers from wearing masks—something employed by the Trump administration, which they argue is necessary for officer safety.
According to the ACLU, “Lawmakers took decisive action to protect the rule of law, recognizing that the very rule of law is under attack when ICE agents can make warrantless arrests inside Virginia courthouses. It is shocking that Governor Spanberger has chosen to veto the protections these bills were supposed to provide and replace them with executive orders that do nothing to keep Virginians safe.”
Neither the governor’s office nor ICE responded to requests for comments regarding these developments. The Trump administration has previously contended that prohibiting immigration officials from wearing masks is unconstitutional, winning a favorable ruling in an appeals court over a similar situation in California.
Spanberger, who has been in office since January, expressed that judicial warrant requirements for ICE presence in courthouses and schools create significant legal liabilities for local law enforcement. She stated, “As a former law enforcement official, I share the concerns of many Virginians regarding unchecked federal immigration enforcement we have witnessed across the nation.”
However, she acknowledged, “While I appreciate the goals and intended purpose of this bill, the reality is that this bill fails to achieve its intended purpose. This proposal would be unfeasible, as it would effectively require the deployment of the Guard and sometimes put local law enforcement in the difficult position of having to choose between state and federal law violations.”
After vetoing the bills, Spanberger issued an executive order requiring ICE to obtain a “valid warrant or order” in such cases, though she did not clarify if this meant a judicial warrant specifically. Typically, ICE utilizes administrative warrants based solely on enforcement authority to further their investigations.
Additionally, Spanberger ended a contract with Trump’s ICE that previously allowed the state agency to assist with immigration operations.
Despite her actions, ACLU activists maintain that Spanberger’s explanation and her record regarding ICE still fall short. The group stated, “Let’s be clear: state courts are controlled by the state of Virginia, not the federal government, and the governor’s actions today amount to a voluntary surrender of that authority to the Trump administration and its lawless anti-immigrant policies. The governor ran and won on a promise to keep all Virginians safe, and today she broke that promise by refusing to take on ICE and allowing ICE to continue to use Virginia courthouses as hunting grounds.”
