President Donald Trump’s substantial immigration enforcement proposal, totaling nearly $70 billion, is now faced with uncertainty as it enters a lengthy Senate voting process that could jeopardize the entire bill.

The primary concern revolves around the now-defunct $2 billion “anti-weaponization” fund from the Department of Justice, which has drawn criticism from both political parties. This uncommon situation highlights a rare moment of shared dissatisfaction that could prove disastrous for the overall package.

Both Democrats and Republicans are preparing amendments aimed at preserving this fund, marking a significant point of contention in the ongoing debate.

Republicans Advance ICE Funding After Controversial Fund Withdrawal

Senate Republican leaders are working to ensure these amendments don’t make it through during this new voting phase, although it’s far from certain. On a positive note for Republicans, during an initial procedural vote, all Republican members were in favor of the package.

Senate Majority Leader John Thune expressed optimism about the effort, saying, “I feel good going into this effort. I’ve had numerous discussions with members who recognize what’s at stake and how crucial it is to reject any amendments that might undermine the bill.”

A significant concern is that if an amendment targeting the fund is accepted, it could obstruct the bill’s progress toward a simple majority vote, essentially granting Democrats a win by derailing the entire package.

The decision on whether to view the amendment under a simple majority or a more demanding 60-vote threshold could significantly alter outcomes, with a Senate rules judge ultimately deciding on its alignment with the Byrd Rule governing the reconciliation process.

Republicans Urge Trump to Eliminate Controversial Fund Before Restoring ICE Funding

Republicans are counting on these modifications to help reach the necessary 60 votes, offering them some flexibility.

Thune noted, “We can never know with 100% certainty. There are numerous clever ways to frame amendments, but we believe most will achieve the 60-vote support.”

This fund was introduced last month as a part of a settlement involving the Trump family and the IRS. However, it faced significant opposition from Republicans who were concerned about possible misuse of taxpayer money by individuals involved in the January 6, 2021, Capitol riot.

Senate Majority Whip John Barrasso has stated his responsibility is to persuade hesitant Republicans to support the bill, even with existing divisions within the party, pointing fingers at Senate Democrats for the ongoing issues.

Republicans Seek to Render Trump’s Controversial Fund ‘Non-Existent’

“Democrats are focused on everything but actually ensuring security at the border and safeguarding American citizens,” Barrasso remarked. “They’ll bring all kinds of proposals, just to stall our efforts to assist the public and keep them secure.”

Yet, some Republicans are themselves proposing amendments related to the anti-weaponization fund. Notably, Senator Thom Tillis, who has distanced himself from Trump recently, is among those looking to introduce additional measures.

Another option could be addressing the funds outside this settlement framework.

Discussion On Path Forward Continues

Mr. Cassidy, who recently parted ways with Trump, didn’t specify his preferred direction but emphasized a need for a solution that prevents arbitrary changes from the White House.

Tillis mentioned that there’s a growing number of Republicans concerned about the fund, and he hopes any actions will be led by Republicans. He appears flexible about whether his amendment passes.

“I’m open to adjustments,” Tillis stated. “There are bills moving forward as long as everyone involved addresses the issue. I’m determined not to compromise leadership or the integrity of the bill to the point of losing crucial aspects. But we must act on this.”
