Justice Department takes legal action against two states over recent gun seizure efforts

Justice Department Challenges Gun Legislation Ahead of Independence Day

In the lead-up to the 250th anniversary of American independence, the Justice Department is criticizing the latest Democratic efforts to limit gun rights in the United States.

On Wednesday, the Justice Department filed lawsuits against two states led by Democratic governors in response to recent measures aimed at banning certain firearms.

The lawsuits target California and Virginia, contesting a ban on Glock brand firearms in California and a prohibition on semi-automatic rifles in Virginia.

According to the Justice Department, California’s policies on firearm approvals—specifically regarding Glocks—undermine the rights of gun owners. They noted that nearly 40 models of Glocks had been removed from California’s list of permitted firearms, a step that limits sales, imports, and manufacturing in the state.

The specific legislation in question was signed by California Governor Gavin Newsom late last year. Under this new law, certain handguns, including numerous Glock models, are banned effective from January 1.

Furthermore, the law also removed over 70 models from other firearm manufacturers from its list of approved firearms on the same date.

During discussions prior to the bill’s passage, gun rights advocates expressed concerns that its language could unjustly restrict access to popular firearms, implying a gradual path toward broader bans.

Acting Attorney General Todd Blanche emphasized the importance of the Second Amendment in a press release, asserting that California cannot impose a ban on one of America’s most favored handguns. He reiterated the commitment to defend the rights of legitimate gun owners against what he termed interference by the state government.

In response, a spokesperson for Newsom contended that California’s gun safety laws are rooted in evidence-based approaches that have proven effective in reducing gun violence, reinforcing their stance that these laws will ultimately save lives.

Alongside the actions regarding California, the Justice Department’s lawsuit against Virginia addresses a new law that restricts the sale and purchase of conventional semi-automatic rifles, enacted by Governor Abigail Spanberger.

This measure effectively halts the market for assault rifles in Virginia, similar to California’s approach concerning handguns.

Both states are facing lawsuits simultaneously, strategically launched as these laws are set to take effect. Assistant Attorney General Harmeet K. Dhillon remarked on the constitutional implications, indicating that law-abiding citizens should not face legal repercussions for exercising their Second Amendment rights.

As of now, there has been no comment from Governor Spanberger’s office regarding the lawsuit.
