Minnesota Red Flag Law in Effect as of January 1, 2024

Minnesota's red flag law goes into effect on Monday, January 1, 2024, and allows police or family members to petition a judge to order guns taken away from specific individuals.

CBS News report Minnesota's red flag law is built on varying degrees of extreme risk orders, which can confiscate guns for periods ranging from two weeks to a year.

Renville County Sheriff Scott Hable, president of the Minnesota Association of Chiefs of Police, said when asked how his officers and deputies would approach the task of confiscating firearms, he said he expects people to surrender their guns peacefully. He said there was.

Hable suggested that law enforcement could execute a search warrant if the gun owner does not willingly surrender the firearm.

California adopted the nation's first red flag law in 2014, which went into effect in 2016. California law, like Minnesota law, is built on extreme risk orders.

Five years after the red flag law went into effect, California led the nation in “active shooters.”
