President Joe Biden's Department of Justice (DOJ) filed a lawsuit against the state of Texas on Wednesday to prevent state authorities from arresting and deporting undocumented immigrants.
Last month, Texas Gov. Greg Abbott (R) gave state law enforcement the power to arrest illegal aliens for the crime of illegally crossing the U.S.-Mexico border and gave local judges the power to crack down on illegals. Signed three bills, including giving. Foreigners were expelled.
Shortly afterward, Justice Department officials began threatening to sue Mr. Abbott unless he vowed not to enforce statewide immigration policies.
On Wednesday, Deputy Attorney General Vanita Gupta said: announced The Department of Justice announced that it has filed a lawsuit against the state of Texas, citing the U.S. Constitution's Supremacy Clause and Foreign Commerce Clause as evidence that the policy is unconstitutional.
“SB4 is clearly unconstitutional,” Mr. Gupta said in a statement.
“Based on the Constitution's Supremacy Clause and longstanding Supreme Court precedent, states cannot adopt immigration laws that interfere with the framework established by Congress,” continued Mr. Gupta. “The Department of Justice will continue to fulfill its responsibility to uphold the Constitution and enforce federal law.”
The Justice Department is asking a federal judge to declare these policies unconstitutional and therefore unenforceable by Texas authorities.
