Indianapolis homeowner says he wrestled gun away from home intruder and shot him to death

A homeowner is shaken after struggling with a man who broke into his Indiana home and fatally shooting the suspect with his own gun.

brent smith spoke with WRTV-TV In what police say was a thwarted home invasion attempt in Indianapolis on Tuesday.

Smith said she was returning to her home on Rue de Marseille from the grocery store when she saw a young man come to her door wearing a ski mask.

He said the incident happened so quickly that he didn't realize what was happening until he was hit by the assailant.

“He hit me in the head with the gun,” Smith said. “He thought the neighbors could hear him, so he yelled, 'He's robbing me!'”

Smith said he had a scuffle with the assailant to get his gun, but the intruder then fled the home.More gunshots were heard as Smith fired at the man. be fired towards him from outside.

“At this point, I started hearing what felt like thousands of gunshots,” he continued.

He said he fired shots outside with the intruder's gun and then fired with his own gun. He saw a group of people get into a car and drive away at high speed.

The Marion County Coroner's Office later identified the dead intruder as 22-year-old Damon Swanigan Jr.

Smith was emotional as he recalled the moment he realized he had shot the intruder.

“That didn't make sense, man, I didn't want to do that!” she said, wiping away her tears. “I didn't want to do that.”

WRTV reported that more than a dozen gunshots were fired near the man's home, including one that broke the windows of his home and a car parked in front of his home.

Smith was detained and questioned, but was released by police. A gun rights attorney who spoke to WRTV said the Marion County Prosecutor's Office is investigating the incident, but it is unlikely he will be charged.

“You need to find something productive to do,” Smith said. “You don't have to rob me. I'm just looking out for myself. The first thing I noticed was that the kid was wearing new Jordans. You tried to rob me. And you were wearing brand new Jordans? I just don't understand.”
