‘Don’t get roofied!’ Calif. law will soon require bars and clubs to offer drink tests for date-rape drugs

A new California law known as AB1013 will soon encourage bars and nightclubs in the state to sell kits that detect the presence of so-called date rape drugs.

drugs Commonly referred to as “roofies” such as Rohypnol, ketamine, or GHB, when surreptitiously slipped into drinks, can cause ingesters to become disoriented or completely unconscious. However, according to AB1013, certain “strips, stickers, straws, and other devices” may be able to detect the presence of such drugs relatively quickly when placed within a substance.

Member of Parliament Josh Lowenthal, D-Long Beach, introduced AB1013 last year and it was signed into law last October. Lowenthal explained that the new law aims to make a night out on the town safer, especially for “women and members of the LGBTQ community.”

If it is cited, KFSN-TV Believe it or not, date rape drugs are a big problem in California watering holes. In fact, Lowenthal called it a “crisis.” “Some of my staff are roofed,” he said. “Some members of Congress have their roofs covered.”

“It happens all the time,” said Daniel Aguilera of Oakland. “I used to work at a bar and someone got on the roof there once, so I've seen it too.”

AB1013 Required for anyone who owns or applies for a Type 48 liquor license. facility Primarily restaurants, but not bars or nightclubs that cater to patrons over the age of 21, offer such date rape drug kits for purchase. The bill says the price of these kits must be “reasonable” compared to wholesale prices, but the law “precludes Type 48 licensees from providing drug testing equipment free of charge to their customers.” It is not.'' Tests must be current and Licensee is responsible for ensuring that the test has not expired.

To ensure patrons are aware of the kits, the law also requires bar owners to post a scripted notice about the kits in a “conspicuous and conspicuous location” inside their establishments. “Keep your roof up. Drinkspike drug test kits are available here. Ask a member of staff for more information,” the scripted message reads.

The law is scheduled to officially take effect on July 1st and is set to expire on January 1st, 2027 unless extended. However, even if the law were to go into effect, its enforcement would be nearly impossible by design. The text of the law clearly states: “A violation of this provision is not a crime.”[e]Current law generally provides that a violation of this law is a misdemeanor. ”

The purpose of this law is to deter predators from slipping substances into the drinks of unsuspecting victims, encourage establishments to voluntarily cooperate with the law, and encourage establishments to cooperate with the law on their own volition to prevent predators from consuming alcohol in or near their The aim seems to be to raise awareness of the dangers of this.
