Schools Allowed to Hide Students’ Trans Identities from Parents

California's constitution allows schools to hide a student's transgender identity from parents, state Attorney General Rob Bonta said. claimed in legal warning I went to the school district late last week.

Bonta would require school districts across the state to require school officials to notify parents if a student requests to identify by a different name or pronouns, play on a sports team or use facilities of the opposite sex. He warned against policies mandating this. Bonta writes:

The California Attorney General's Office issued this legal warning to remind all school boards of their mandatory gender identity disclosure policies. The policy targets transgender and gender nonconforming students by requiring school officials to disclose a student's gender identity or gender nonconforming to a parent or guardian. Explicit student consent – violates state law.

“…[S]ah The policy requires transgender and gender nonconforming students to hide their identity at school or share their identity with parents or guardians who believe it may harm them emotionally, psychologically, or physically. “By forcing them to make that choice, they are doing harm,” he added. “Many students feel forced to stay in the closet when forced to make this decision.”

In his four-page memo, Bonta argued that these policies violate state law and the state constitution in three ways.

First, the Democratic attorneys general argued that the “forced disclosure policy” violates California's Equal Protection Clause “by explicitly discriminating on the basis of gender identity.” Second, it argued that such policies violate the country's statutory prohibition against discrimination “on the basis of gender identity.” Third, he argued that “forced disclosure” violates students' state constitutional privacy rights “with respect to how and when they disclose their gender identity.” Bonta continued:

These privacy and autonomy interests are protected by the California Constitution, and the state and local school districts must not only protect student privacy under the circumstances here, but also ensure that transgender and gender nonconforming students are physically We also have a compelling interest in ensuring that we are protected from a reasonable risk of harm. , the emotional and psychological harm caused by forced disclosure.

The memo was released amid a legal battle with Bonta. The Chino Valley School District announced a policy in July to protect sexually confused minors from schools that promote gender ideology after a 4-1 school board vote.judgement blocked Part of the policy for October 2023.

Chino Valley School Board President Sonya Shaw, who supported the policy, accused Bonta of being “obsessed with power.”

“He has shown that he wants to be a parent to our children and is not doing his job of keeping California safe,” Shaw said. told KCAL. “What is he doing to keep his parents out and keep them safe on campus? It just makes no sense.”

Chino Valley attorney Jacob Hebert told the media that Bonta presumes all parents are abusers.

“What the attorney general has done here is presume that all parents are abusers,” he said. “So we have to keep this information from all of them, and that just doesn't make any sense.”

In another California case, the Spreckels Union School District in Monterey County last year settled for $100,000 with a mother who claimed her daughter was “socially transitioned” to a boy at school without her knowledge.

California also became a notable “sanctuary state” in 2023 for “transgender children” seeking drugs and surgeries to change the physical manifestation of their secondary sex characteristics, although this Restricted by state.

Last year, the California Legislature went further, passing a bill allowing courts to consider a parent's affirmation of a child's “gender identity” in custody cases. Democratic Gov. Gavin Newsom took a surprising move. vetoed the bill.
