Legal experts said Fulton County District Attorney Fani Willis is unlikely to be disqualified from prosecuting former President Donald Trump, but she could still be dismissed from the case.
Willis faces allegations that he had an “improper” relationship with Nathan Wade, the special prosecutor hired to prosecute Trump and 18 others on racketeering charges for trying to overturn the 2020 Georgia election. ing. Mr. Trump’s co-defendant, Michael Roman, and his defense attorney said that Mr. Willis went on vacation with his girlfriend, Wade, and that the vacation was paid for by taxpayers’ money that Mr. Willis’s company received for its work on the case. He claimed there was a conflict of interest because he was allegedly paid.
“Courts rarely dismiss cases based on these allegations,” said George Washington University law professor and Fox News contributor Jonathan Turley. “However, the court could force Mr. Wade and Mr. Willis to dismiss on suspicion of misconduct.”
“What is clear now is that Mr. Wade and Mr. Willis are harming the case and the firm by continuing to litigate, and that is as concerning as the underlying charges,” he said. “They put their own interests ahead of those of the office and the public. The disbarment was brought to court after Mr. Wade and Mr. Willis claimed that all significant transactions were processed in untraceable cash. This is a difficult challenge for us.”

Defense attorneys took to the stand on Thursday and Friday former friends and co-workers of Wade and Willis, who said the two began a romantic relationship in 2019, years before they claim in court filings that their relationship began. He testified. Willis and Wade both claimed their relationship began in 2022 after Wade was hired to prosecute Trump.
But Robin Yearty, a former “good friend” of Willis and a former employee of the DA’s office, disputed their story.
Ms Yearty told the court there was “no question” that Willis and Wade’s relationship began after they met at a press conference in 2019. She observed Willis and Wade “hugging” and “kissing” and showing “affection” prior to November 2021, and that the two dated between 2019 and her last relationship with Willis. He testified that he had no doubt that they were in a “romantic” relationship. she said in 2022.
The defense also asked Terrence Bradley, Wade’s former partner and one-time divorce lawyer, to testify that the relationship began in 2019. However, Bradley declined to answer some questions from his defense attorney, citing attorney-client privilege. Judge Scott McAfee said Friday he would meet with Mr. Bradley “in camera” to determine whether his claims of privilege were accurate.

She argued for hours with her lawyer, and at one point the judge threatened to quash her testimony.
“You’re confused! I’m not on trial. These people are on trial for trying to steal the 2020 election,” Willis said in response to a series of questions. She did not return to her witness stand Friday.
Her father, John C. Floyd III, testified Friday and admitted that he taught her to always keep large amounts of cash on hand.

He also said he didn’t meet Mr Wade until 2023 and didn’t know his daughter had been romantically involved with him until about seven weeks ago, when allegations of Wills’ cheating were first filed in court. Stated.
John Acevedo, Associate Professor, Emory University School of Law told FOX 5 Atlanta It seems unlikely that Willis will be disqualified from prosecuting Trump.
“This is a little far-fetched,” he said after reviewing an evidentiary hearing this week in Fulton County Superior Court. “She clearly does not receive her salary directly, and instead the theory that has been put forward is that she received her gift from Wade out of the salary that she is being paid to prosecute the defendants. That is what I am receiving.”
Acevedo suggested that the defense has not yet been able to prove any direct benefit to Willis from hiring Wade. But the Emory professor told FOX 5 Atlanta that the case is likely to turn bad for Willis, an Emory alumnus, anyway.
“Cash redemptions and revelations of the start of a relationship can lead to rejection here simply because it seems inappropriate, even if there is nothing actually wrong with it. ” he said.

Judge McAfee said earlier this week: “It is clear that disqualification may occur if evidence of an actual conflict or the appearance of a conflict is presented.”
If the judge decides that Willis should be disqualified or removed from office, a new prosecutor will be appointed to handle the election interference case, and he could choose to leave the case completely blank. Otherwise, Willis could continue to press charges against Trump and others, leading to a potential trial later this year.
Mr. Turley said Mr. Wade and Mr. Willis should have already stepped aside.
“In my opinion, the most serious charge is that Willis and Wade made false statements and submissions in court,” he told FOX News Digital. “They are charging defendants with making or submitting false statements. In Wade’s case, this goes beyond the question of when their affair began. Both Willis and Wade turned themselves in several weeks ago. ”
