The Biden administration has asked the Supreme Court to block a Texas law allowing local police to arrest illegal immigrants, saying it would “disrupt the United States’ efforts to administer federal immigration laws in Texas.”
The Fifth Circuit Court of Appeals on Saturday reversed a lower court’s decision to block the law pending litigation, allowing it to take effect as early as this weekend unless the Supreme Court intervenes. Attorney General Elizabeth Preloger told the court in the government’s application Monday that it would have the effect of “sharply changing the status quo that has existed between the United States and the states regarding immigration for almost 150 years.” (Related: Federal appeals court says Texas law allowing police to arrest illegal immigrants can take effect)
“By allowing Texas to remove noncitizens to Mexico without their consent, SB4 would have a significant and immediate negative impact on the U.S.-Mexico relationship. is critical to the federal government’s ability to respond effectively,” Preloger wrote. “SB4 would undermine the federal government’s relationships with other countries and prevent the United States from conducting assessments under the Convention on the Transfer of Noncitizens to Countries Where They May Be Subject to Persecution or Torture.”
Texas has a constitutional right to defend itself as President Biden continues to neglect his duty.

The Department of Justice filed a lawsuit over Texas’ SB 4 in January, shortly after Texas Governor Greg Abbott signed the bill in response to a record increase in illegal crosswalks.
“In contrast to the significant harm that enactment of SB4 would inflict on the United States, the state of Texas will receive no measurable harm from a preliminary injunction that merely maintains the long-standing status quo while this litigation proceeds.” ,” the government claimed on Monday.
