GOP Senator Censured Over Border Deal

Oklahoma County Republicans on Saturday criticized U.S. Sen. James Lankford over his efforts on a failed border security deal.

The party’s convention in Oklahoma City voted overwhelmingly to censure the senior Republican senator. “People spoke out,” county party chairman Ken Warner told The Oklahoman.

“It’s really because he says he’s going to allow 5,000 illegal aliens a day,” Warner said. “It was part of the border bill. … That was one of the things that was there.”

He estimated that 225 Republicans attended the convention.

According to information obtained by Fox News reporter Bill Melgin, the deal includes:

  • Forced detention of all single adults.
  • If the average number of migrant encounters per day reaches 5,000, the border will be forcibly “closed.” Importantly, his 5,000 number includes his 1,400 CBP One app entries at ports of entry per day and approximately 3,600 illegal crossings per day.
  • How will it be enforced? Once the 5,000-person threshold is reached, new powers will be codified into law requiring the Border Patrol to immediately remove illegal immigrants it captures without processing them. They cannot apply for asylum and will be expelled immediately. This includes deportation to Mexico and repatriation. This would be a “significant” change from current policy, which requires that once illegal immigrants reach U.S. soil, they must be processed under Title 8 and allowed to apply for asylum. Under this new permission, they will not be processed and will be forcibly removed immediately upon reaching the “shutdown” threshold.
  • This “closure” will also be in effect if the country encounters 8,500 migrants a day.
  • The “closure” will not be lifted until the next day. It will not be lifted until the number of daily encounters decreases to below 75% of the 5,000 standard for at least two weeks. This means “closure” powers will not be lifted until two weeks have passed when encounters with migrants have averaged fewer than 3,750 people a day.
  • Some family units will be released with an ATD (alternative to detention, ankle monitor, etc.).
  • New expulsion powers to immediately expel all immigrants without a valid asylum claim. This is expected to be decided within six months, rather than the current multi-year process.
  • Immigrants who attempt to cross twice during the “closure” phase will be barred from entering the United States for one year.
  • The US would need an agreement with Mexico for MX to take back non-Mexican illegal immigrants. This is still not resolved.
