A Manhattan judge has set a trial date for Daniel Penny on October 8th, the next step in an unwarranted Kafkaesque ordeal that should never have begun.
That the charges of second-degree manslaughter and criminally manslaughter against a 25-year-old Marine veteran were not dismissed (and were even prosecuted in the first place) is a travesty, a point made even more clear by a local newspaper in Brooklyn. The prosecutor’s office last week declined to file charges after Younes Obouad shot and killed Dajuan Robinson on the A train in self-defense.
On May 1, 2023, Penny also put herself and others in a chokehold on the F train in Manhattan when she put Jordan Neely in a chokehold after the 30-year-old homeless man lashed out at her with “insane threats.” They were acting to protect the passengers. He even made his way to where other passengers were hiding and praying, according to court documents.
And last June, a month after Penny’s arrest, a grand jury declined to indict Jordan Williams for stabbing the man who attacked him on the J train.
All of these tragedies have similar themes and outcomes. So why is Penny still in legal hell and at risk of a 19-year prison sentence when both Obuad and Williams have been released?
Penny’s story quickly spread on social media, with Manhattan District Attorney Alvin Bragg calling the high-profile case a “problem for someone to act in public and put themselves or others at risk.” This is because I wanted to send the message, “Please don’t get involved in sexual situations.” other than that.
Bragg showed similar disdain for self-defense in 2022, when he charged Jose Alba, a bodega employee, with second-degree murder for stabbing a career criminal who attacked him over a bag of chips. (Only after a huge public outcry did prosecutors relent and drop the charges.)
Not only does Bragg not keep you safe, he doesn’t want you or anyone else to be safe either.
Have you ever been trapped in a subway car with a horrifying maniac (which is happening more and more these days)? In Manhattan, your choices are: 1) cause serious harm, or 2) receive a harsh prison sentence. It’s about taking that risk.
And Mr. Bragg’s fellow progressives aren’t even going to make it easier for authorities to force treatment on dangerous mentally ill patients. The entire prog movement is dedicated to protecting the prog movement as a whole. every Threat to public order and decent quality of life.
New Yorkers need to stop electing “public officials” who have nothing but contempt for actual citizens.
