Hunter Biden’s defense team was dealt a blow in court Friday after a federal judge in Delaware ruled that the federal gun case against the president’s son will continue.
Biden is accused of lying about drug abuse during a background check when he applied for a gun license in October 2018. He is charged with two counts of lying about drug abuse while attempting to purchase a weapon and one count of unlawful possession of a firearm while intoxicated by a controlled substance.
His lawyers argued that the lawsuit against Biden was politically motivated, but the judge who heard the motion disagreed.
U.S. District Judge Maryellen Noreika said she had not presented “anything concrete” to prove that Republican efforts against Biden led to the charges against him.
“While the pressure campaign from Congressional Republicans may have occurred around the time the special counsel decided to proceed with the indictment rather than pretrial diversion, the court did not consider the conduct of these members (or others) Nothing has been given that credibly suggests that there was any influence on the Special Counsel,” Noreika wrote. “It’s all speculation.”
Biden’s lawyers also argued that Biden committed no crime and that first-time users could not face criminal charges.
Prosecutors argued that the evidence against Biden was “overwhelming” and included cocaine residue found in the pouch where he kept his gun.
Biden also faces separate charges in California related to tax evasion charges, including withholding $1.4 million owed to the government and filing false tax returns. His lawyer had asked eight times for these charges to be dropped, but the judge in charge of the case allowed them to continue.
Biden’s trial on the firearms charges could be held in June, when his father is in the midst of his re-election campaign.
Judge Noreika was appointed by former President Donald Trump in 2018 with support from the Democratic Party.she is still issued The ruling for Biden’s defense was that the charges violated his Second Amendment rights.
