Disgraced former Hollywood producer Harvey Weinstein scored a major legal victory Thursday when a New York appellate court overturned his 2020 rape conviction.

In appealing Weinstein’s conviction, his lawyers argued that Molyneux’s testimony and cross-examination were unfairly prejudicial to him.
The New York Court of Appeals later agreed. In a narrow 4-3 decision, the court ruled to overturn the conviction in the case.
The appeals court found that Judge James Burke, who oversaw Weinstein’s trial, made a serious “error” in giving testimony “unrelated, prejudicial and untested allegations of past wrongdoing.” he claimed.

The three dissenting judges directly addressed the issue of Molyneux witnesses, lamenting that the decision could ultimately quickly end the use of Molyneux witnesses in sexual assault cases.
However, the minority justices particularly took issue with the majority’s “fundamental misunderstanding” of sexual violence by powerful people. In fact, the minority effectively insulted their colleagues on the panel, suggesting in their dissent that the majority may not actually be seeking justice in sexual assault cases.

Weinstein’s spokeswoman Judah Engelmayer said she was “cautiously excited” about the verdict, but added that Weinstein “still has a long way to go.”
