Trump was charged with 34 felonies for falsifying business records related to payments to his former lawyer Michael Cohen. Mr. Cohen claimed he received payments from Mr. Trump as reimbursement for the $130,000 in so-called hush money he paid Mr. Daniels to keep quiet about the affair allegations.
The former president has denied the affair allegations and has pleaded not guilty to all charges.
“We are moving for a miscarriage of justice based on the testimony of this witness. …Much of the testimony this witness spoke today is based on the testimony she gave in 2016,” Blanche told acting judge Juan Mercian on Tuesday. “It’s very different from what was advertised.”
“She was talking about a consensual encounter with President Trump and trying to sell that…and that’s not the story she talked about today,” he continued. “But now we’re hearing it. And that’s the question: How can we ring the bell?”
Marchand denied the defense’s motion for a mistrial and criticized Trump’s lawyers for not further objecting to Daniels during his testimony.
Defense cross-examination of Daniels continued Thursday morning. After testifying, Blanche said the defense plans to file another motion for a mistrial over Daniels’ statements. Lawyers also said they would reintroduce a motion to block the testimony of former Playboy model Karen McDougal, who claims she received so-called hush money to keep quiet about her alleged affair with Trump.
The prosecution informed Blanche that they did not plan to call McDougall as a witness.
“She was on our witness list, but we never indicated any actual intention to call her,” said prosecutor Joshua Steinglass.
Blanche also said the defense wanted to raise the issue of the judge’s gag order against Trump. Blanche asked Trump to “allow me to publicly respond” to Daniels’ testimony. He said the former president “will be questioned repeatedly over the next week or two about these new accusations of consent and what happened that night.”
“He’s not allowed to say, ‘I didn’t do that,'” Blanche told Marchand.
“The press reporting over the past 24 hours on the current version of the story, which we believe to be completely false, is a completely different type of denial and reporting than we have seen going back to 2011 and 2014,” Blanche said. He continued. “As we have said repeatedly, he needs an opportunity to answer to the American people. The grounds for a gag order regarding Ms. Daniels have ended. She is no longer a witness.”
Prosecutor Chris Conroy argued that Trump should have responded to Daniels’ testimony in court, not to the media.
“If someone wants to react to something said in this room, it can happen in this room. It shouldn’t happen outside,” Conroy said. He argued that lifting the gag order would have “very real consequences for witnesses”.
Mr Marchand rejected Mr Blanche’s request to change the gag order.
“My interest is not only in protecting Ms. Daniels and the witnesses who have already testified. My interest is in protecting the integrity of these proceedings as a whole,” Marchand told Blanche. “Others will see you doing it. … Not just Michael Cohen, but other witnesses will see your client doing whatever it is he intends to do.” Sho.”
