A judge has ruled that the girl accused of beating classmate Kaylee Gain into a coma cannot be prosecuted as an adult.

A St. Louis judge said Wednesday that the case will remain in juvenile court after reviewing the suspect’s school history, which has not been named, and meeting with the girl and her family.
March 8NumberGaine, 16, was seriously injured during a fight outside Hazelwood East High School.
Video footage shared on social media showed the suspect attacking Gein by jumping on top of him and repeatedly slamming his head against concrete.
Gaine’s family said she eventually woke up from the coma but still had a long road to recovery.
The girl’s lawyer, Greg Smith, said in court Wednesday that Gein had previously been suspended from school for fighting with a 15-year-old girl and that he punched her first.
Smith argued that his client had been well behaved during his time in juvenile detention, had a stable home life and performed well academically.
After the fight, Gein spent months in the hospital before returning home.
She still suffers from short-term memory loss, attends physical and speech therapy several times a week, and is due to have surgery soon to repair missing parts of her skull, but overall she says she is doing well so far.
Brian Kemmerer, an attorney for Gein’s family, said earlier this month that Gein continues to suffer from “the trauma, fear and pain resulting from this incident.”
He also said Gein’s family would “respect” the judge’s choice to try the 15-year-old as an adult or a juvenile.
The boy’s family said he had received multiple “racially motivated” threats since the incident and that he had acted in self-defence.
