Judge Denies Motion To Dismiss Alec Baldwin’s ‘Rust’ Indictment

According to court records: Fox News DigitalThe judge rejected Baldwin’s two arguments for a grand jury hearing, finding they were not prejudiced against him.

The defense argued that the prosecution violated grand jury rules to distract attention from witnesses and exculpatory evidence.

The prosecution denied the allegations, slammed the lawyer as “shameless” and highlighted contradictions in his testimony.

“We look forward to our day in court,” Baldwin’s attorneys, Alex Spiro and Luke Nikas, said in a statement.

Baldwin’s defense team appeared virtually and argued that the prosecution violated the law when the grand jury was deliberating. Baldwin’s lead attorney, Alex Spiro, focused on the argument that the prosecution failed to inform witnesses before the grand jury.

“The way it works is the grand jury will convene in a week and all of the witnesses will be subpoenaed to come before the grand jury or be on standby and will speak,” Spiro said during the May 17 hearing.Number At the hearing, we were told, “This is not the way it should be done.”

But special prosecutor Kari Morrissey argued that Spiro’s claims were a “complete misinterpretation” of what actually happened.

“I’m not going to sit here and be called a liar,” she added.

Baldwin’s defense team countered that prosecutors acted unethically and failed to present key evidence to the grand jury in their original motion to dismiss the indictment.

“Enough is enough,” the court documents state. “This is an abuse of the system and an abuse of innocent people whose rights have been severely violated.”

Baldwin subsequently filed two more motions to dismiss, one for failure to plead a crime and one for destruction of evidence (related to a firearm).

The state responded to both motions on May 21, though a court hearing has yet to be set.st.
