Penalties for Hunter Biden’s Alleged Gun Crimes Include Jail Time

Hunter Biden’s trial on three gun charges begins Tuesday, and penalties for some of the charges include prison time and heavy fines.

NBC News I got it. “Two of the charges charge that Hunter Biden filled out paperwork stating he was not using illegal drugs when he purchased a Colt Cobra revolver in October 2018,” it said. “The third charge alleges he possessed a firearm while using drugs.”

The document Biden allegedly lied about is ATF Form 4473, a firearms transaction document used to undergo a National Instant Criminal Background Check System (NICS) check when purchasing a gun at a retail store.

Here’s how the process works: A prospective buyer fills out ATF Form 4473 and gives it to the Federal Firearms License (FFL) holder. The holder calls the FBI, relays the information on the form, and receives permission to sell the gun or a denial (meaning the gun cannot be sold to the prospective buyer). A third option is for the FBI to inform the FFL holder that it will extend the background check for an additional three business days to allow additional time for FBI screeners to verify criminal history.

ATF Form 4473 is critical to the integrity of the NICS check. One of the questions in it reads:

Are you illegally using or dependent on marijuana, sedatives, stimulants, narcotics, or other controlled substances? WARNING: Regardless of whether marijuana has been legalized or decriminalized for medical or recreational purposes in the state in which you reside, the use or possession of marijuana remains illegal under federal law.

The form allows you to enter one of two answers to this question: “yes” or “no.”

Penalties for making a false statement on an ATF Form 4473 include a fine of up to $250,000 and/or 10 years in prison.
