Hundreds of thousands of migrants have been allowed to remain in the U.S. after deportation cases against them were dropped under President Joe Biden’s administration.
Under the Biden administration, there has been an explosion in the number of immigrants whose deportation cases have been dropped and who have been allowed to remain in the U.S., according to federal data analyzed by Syracuse University’s Transactional Records Access Clearinghouse (TRAC).

By contrast, during former President Donald Trump’s term, roughly 60% of migrants with pending cases were ordered deported from the U.S., the TRAC researchers noted.

The announcement comes as the U.S. immigration court backlog has tripled under the Biden administration, to more than 3.5 million cases, from about 1 million when the Trump administration left office.
Most significantly, there are an estimated 8 million more illegal immigrants living freely across the United States because they are on the federal “non-detainer list,” nearly triple the 3.2 million on the non-detainer list in 2020.
