Biden Order Unlikely to Stop Mass Release of Migrants into U.S.

President Joe Biden’s executive orders regarding the U.S.-Mexico border are unlikely to stop the administration from releasing large numbers of migrants into the United States. analysis from the left-leaning American Immigration Council states.

The order, detailed by Breitbart News, allows the Department of Homeland Security (DHS) to restrict border areas between ports of entry only after encountering an average of 2,500 migrants per day over a seven-day period.

That equates to about 17,500 migrants arriving at the border each week, or roughly 1 million migrants per year.But the order is packed with exceptions for subgroups of migrants who can still apply for asylum despite being stuck at multiple ports of entry.

The analysis by the American Immigration Council said it was unlikely that the Biden administration’s Department of Homeland Security would stop mass releases of migrants into the U.S., saying “if the administration cannot resolve these operational issues overnight, it will likely have to continue releasing large numbers of people into the country.”

The analysis states:

Recent history shows that the United States cannot impose new, more restrictive procedures on everyone. A significant number of people will be released to the US pending trial. Even if a hearing determines that they are ineligible for refugee status. [Emphasis added]

Absent any major changes in the numbers of arrivals or the resources deployed to accommodate them, these practical constraints will be very real considerations. The government may have to issue notices to appear in immigration court and release a significant number of people back into the United States. [Emphasis added]

The analysis found that in the first six months of this fiscal year, more than 671,000 migrants were given a Notice to Appear Before a Federal Immigration Judge (NTA) and released into the U.S. interior – some for nearly a decade.

Tens of thousands of migrants who have arrived at U.S. ports of entry and have scheduled appointments for release into the U.S. via the CBP One mobile app will continue to be allowed for release into the U.S.

Since its launch last year, the CBP One mobile app has helped bring about 600,000 migrants into American communities, more than the population of Wyoming.

Fox News’ Bill Melgin reports that the order has been in place for about two days and has failed to stop mass migration at the border.

“Yesterday was the first full day that President Biden’s executive order barring asylum for most illegal immigrants had no effect on the numbers,” Melgin reports. [Customs and Border Protection] According to sources, the Border Patrol arrested about 4,000 illegal immigrants yesterday, which is in line with recent weeks’ arrests, ranging from the low 4,000s to the mid-to-high 3,000s.”

A few months ago, Reps. Jim Jordan (R-Ohio) and Tom McClintock (R-Calif.) called on Homeland Security Secretary Alejandro Mayorkas to release a “quantitative breakdown of all illegal immigrants released at the southwest border since January 20, 2021.”

Mayorkas declined to provide such data, but the Department of Homeland Security release More than 85% of migrants arriving at the border enter the interior of the United States.
