House Judiciary Committee Officially Sues AG Merrick Garland

Attorney General Merrick Garland was sued Monday by the Republican-led House Judiciary Committee in an effort to force the release of audio recordings of conversations between President Joe Biden and special counsel Robert Hur in the classified documents case.

Hur said Biden experienced repeated bouts of memory loss during the interview, a move Republicans are eager to garner support for amid growing concerns about the president’s age and cognitive abilities.

Hoare’s analysis, published in February, suggested Biden would have portrayed himself to jurors as a kind-hearted “old man with a failing memory,” which he cited as part of his reasoning for not charging Biden with improper handling of classified documents while he was vice president.

However, many political observers and commentators have questioned whether Biden is too “old” with failing memory to be prosecuted in an investigation into classified documents, but not too old to be re-elected for another four years as the next president of the United States.

In a 56-page filing, congressional lawyers said Biden’s assertion of executive privilege to protect a recording of his May interview was “baseless.”

The lawyers also argue that the recordings would provide “better evidence” of the events discussed in the interviews, but the Justice Department has only provided transcripts of the interviews and refused to provide the recordings to Congress.

” [Judiciary] “The Committee needs these recordings in order to evaluate the Special Counsel’s character evaluation of the President,” the lawyers said.

House Republicans last month held Garland in contempt of Congress for refusing to turn over audio recordings in response to a congressional request.

Despite the Justice Department quickly announcing that it would not pursue contempt charges against Garland, arguing that his failure to turn over the tapes “does not constitute a crime,” several House Republicans are now pushing legislation that would order House chambers clerks to arrest and detain Garland.
