“While we believe that defendants’ claims are without merit, we do not object to defendants’ request for leave to file and their putative request to postpone sentencing pending a decision on their motions. We respectfully request that defendants file and serve their answer no later than July 24, 2024, two weeks after the deadline requested by defendants,” the Manhattan District Attorney’s Office said in the letter.
The Manhattan district attorney’s office said it may delay President Donald Trump’s sentencing to allow time for a motion to vacate his business fraud conviction following Monday’s Supreme Court ruling on presidential immunity.
The former president’s sentence is currently scheduled to be handed down on July 11.

The Supreme Court did not apply its ruling to whether former President Trump is immune from prosecution for conduct related to attempts to overturn the results of the 2020 election, so it remanded the issue to a lower court.

Justice Samuel Alito questioned the impact of indicting a former president.
“Does a sitting president who just lost a very close and hard-fought election know that what could actually be nullified after he leaves office is not that he can retire peacefully, but that he could be criminally prosecuted by his bitter political opponents?” Alito asked.
“Wouldn’t that put us in a vicious circle that would destabilize our functioning as a democracy? If you look around the world, you will find countries where you see this process where the losers are imprisoned,” he said.
